These Terms of Service ("Terms") form a legal agreement between you ("User," "you," or "your") and Sterling Mind ("Company," "we," "us," or "our"). By downloading, installing, accessing, or using the ADHD Mind application ("App"), you agree to be bound by these Terms.

If you do not agree with any part of these Terms, you may not use the App. We reserve the right to update these Terms at any time, and your continued use of the App constitutes acceptance of any changes.

1. Agreement to Terms

By using ADHD Mind, you acknowledge that you:

• Have read and understood these Terms of Service and our Privacy Policy
• Are at least 18 years old
• Are legally capable of entering into a binding contract
• Have the authority to bind yourself to these Terms
• Accept all terms, conditions, and obligations contained herein

2. Description of Service

ADHD Mind is a digital wellness and self-care application that provides:

• A 6-week daily hypnotherapy program targeting ADHD nervous system patterns
• Structured audio sessions (15-20 minutes per day) using clinical hypnosis techniques
• Daily pattern insights, breathwork, and self-assessment tools
• Progress tracking and personalized content
• An Emergency Toolkit of shorter sessions for immediate support

What ADHD Mind Is NOT

• Not a medical device or medical treatment
• Not a substitute for professional therapy, counseling, or psychiatric care
• Not a diagnostic tool for ADHD or any other condition
• Not intended to cure, treat, or prevent ADHD or mental health conditions

3. Subscription & Billing

Pricing Tiers

ADHD Mind offers the following subscription options:

• Monthly Plan: $29/month
• Quarterly Plan: $59/quarter (approximately $19.67/month)
• Annual Plan: $149/year (approximately $12.42/month)
• Lifetime Plan: $249 one-time purchase

Auto-Renewal

Recurring subscription plans (Monthly, Quarterly, Annual) automatically renew at the end of each billing period unless cancelled. Your payment method will be charged automatically upon renewal. We will send you a reminder notification prior to each renewal.

Cancellation

You may cancel your subscription at any time through your App account settings or by contacting customer support. Cancellation takes effect at the end of your current billing period. No refunds will be issued for partial months or remaining subscription time.

Billing Disputes

If you dispute a charge, please contact us immediately at privacy@sterlingmind.com with details of the disputed transaction. We will work to resolve billing issues promptly.

4. Free Trial

New users receive a 7-day free trial of ADHD Mind at no cost. During the trial:

• You have full access to Week 1 content and the Emergency Toolkit
• Your trial period begins when you create your account
• At the end of the trial, you must select and pay for a subscription plan to continue using the App
• If you do not cancel before the trial ends, your chosen subscription plan will automatically begin

We will send you reminder notifications before your trial expires. You can cancel anytime during the trial period without charge.

5. Refund Policy

We offer a 30-day money-back guarantee for subscription purchases, with the following conditions:

Eligibility

You are eligible for a refund if:

• You request the refund within 30 days of your initial purchase
• You have completed at least 7 sessions in the App
• You are requesting a refund for a paid subscription (not the free trial)

How to Request a Refund

To request a refund, contact us at privacy@sterlingmind.com with:

• Your account email address
• Date of purchase
• Brief explanation of your reason for the refund request

We will process approved refund requests within 5-10 business days. Refunds will be returned to your original payment method.

Non-Refundable Circumstances

Refunds cannot be issued if:

• 30 days have passed since purchase
• You have completed fewer than 7 sessions
• You are requesting a refund for the free trial period
• Your account is suspended for violating these Terms

6. Medical Disclaimer

CRITICAL: ADHD Mind is NOT medical treatment, therapy, or medical advice.

• The App is a self-care and wellness tool only
• Clinical hypnotherapy provided in the App does not replace professional psychiatric or psychological care
• Assessment data is for self-awareness—not clinical diagnosis or medical records
• We do not diagnose, treat, cure, or prevent ADHD or any other condition

Professional Care

If you have ADHD, mental health concerns, or are in crisis:

• Consult a qualified healthcare provider (psychiatrist, psychologist, therapist)
• Never use ADHD Mind as a substitute for professional care
• For crisis support, contact the National Suicide Prevention Lifeline: 988 (US)

Use Restrictions

Do NOT use ADHD Mind:

• While driving, operating machinery, or in situations requiring alertness
• If you are pregnant or nursing (consult your healthcare provider first)
• If you have a history of psychosis or severe mental illness (without professional guidance)
• In place of emergency medical care

7. User Responsibilities

You agree to:

• Use ADHD Mind only for lawful, personal purposes
• Provide accurate account information and keep it updated
• Maintain the confidentiality of your password and account
• Notify us immediately of unauthorized access to your account
• Comply with all applicable laws and regulations
• Not share your account with others or use multiple accounts to exploit free trials or refund policies

You agree NOT to:

• Copy, modify, or reverse-engineer the App or any of its content
• Use the App for commercial purposes without written permission
• Attempt to access the App's servers or bypass security measures
• Use the App to harass, defame, or harm others
• Share, distribute, or reproduce copyrighted content from the App

8. Intellectual Property

Ownership

All content in ADHD Mind—including hypnotherapy sessions, audio scripts, educational materials, graphics, logos, and designs—is the exclusive intellectual property of Sterling Mind and protected by copyright law.

License to Use

By purchasing a subscription, you receive a limited, non-exclusive, non-transferable license to use the App and its content for personal, non-commercial use only. This license does not grant you ownership of the App or any of its content.

Prohibited Uses

You may not:

• Reproduce, distribute, or publish any content from the App without permission
• Create derivative works based on ADHD Mind content
• Remove or alter any copyright, trademark, or proprietary notices
• Use the App's content in commercial products or services

User Feedback

Any feedback, suggestions, or ideas you provide about ADHD Mind may be used by us without compensation or attribution. We appreciate your input and may incorporate it into future versions of the App.

9. Limitation of Liability

DISCLAIMER: ADHD Mind is provided "AS IS" without warranties of any kind, express or implied.

No Guarantees

We do not guarantee that:

• The App will be error-free or uninterrupted
• Any particular results will be achieved from using the App
• The App is suitable for your specific condition or needs
• Your data will never be lost or compromised

Limitation of Damages

To the maximum extent permitted by law, Sterling Mind shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of income, profits, or business opportunity
• Damages arising from your use or inability to use the App
• Results (or lack thereof) from using ADHD Mind
• Data loss or security breaches (except in cases of our gross negligence)

Our total liability to you shall not exceed the amount you paid for your subscription in the 12 months preceding the claim.

10. Termination

By You

You may terminate your account at any time by:

• Deleting the App from your device
• Requesting account deletion through App settings or email (privacy@sterlingmind.com)

Upon deletion, your account and personal data will be removed within 30 days.

By Us

We may terminate or suspend your account immediately without notice if you:

• Violate these Terms of Service
• Use the App unlawfully or for harmful purposes
• Engage in fraudulent activity (e.g., exploiting refunds or free trials)
• Attempt to hack, reverse-engineer, or breach the App's security
• Harass, abuse, or threaten our team or other users

Effect of Termination

Upon termination:

• Your license to use the App immediately ceases
• You lose access to all subscription content and your account data
• No refunds will be issued for remaining subscription time (unless otherwise required by law)
• Our obligations to you end, except where survival is required by these Terms

11. Changes to Terms

We may update these Terms of Service at any time. We will notify you of material changes by:

• Updating the "Last updated" date at the top of this page
• Sending you a notification through the App or email (if required by law)
• Requiring your acceptance of the new Terms before continued use

Your continued use of ADHD Mind after changes are posted constitutes your acceptance of the updated Terms. If you do not agree with any changes, you must discontinue use of the App.

12. Governing Law & Jurisdiction

These Terms of Service are governed by the laws of the United States, without regard to its conflict of law principles. Any legal action or proceeding arising from these Terms shall be brought exclusively in the federal or state courts located in the United States, and you consent to the jurisdiction and venue of such courts.

13. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Sterling Mind regarding your use of ADHD Mind. They supersede all prior agreements, whether written or oral. If any provision is found to be unenforceable, that provision shall be severed, and the remaining provisions shall remain in full force.
